Reporting Know or Suspected Criminal Acts/Wrongdoing
By Employees in the Southern University System
All knowledge or suspicion(s) of criminal acts or wrongdoing by employees of the Southern University System shall be reported to the Chief of Campus Police. Discovered and/or documentable criminal acts/wrongdoing of employees shall be reported to the Chief of the Campus Police. If reasonable cause exists to suspect criminal wrongdoing, especially of a non-obvious nature, including but not limited to theft, fraud, malfeasance, etc., employees, agents and other persons within or outside of the University shall make his/her suspicion(s) known to the Campus Police Chief.
After taking a complete report, the Chief, shall immediately notify the Campus Chancellor, the System President and the appropriate System Vice President of the known or suspected criminal act(s) in writing. He shall also provide his assessment of the reported information and his initial plans for conducting the investigation to gather evidence necessary to substantiate or prove the know criminal act(s) and to identify the responsible party(ies) or to sustain or dispel the reported suspicion(s).
Following notification to the designated University and System officials, the Chief shall conduct an appropriate investigation of the allegation(s) of wrongdoing. He shall (1) notify and obtain the cooperation and assistance of the appropriate Unit Heads in the gathering of evidence and conducting of interviews; (2) receive all relevant information, evidence and investigative reports; and (3) provide to the Chancellor, System President and the appropriate System Vice President periodic oral and/or written reports which will detail his findings to date.
At the point that the Chief believes that sufficient information and evidence have been collected to prove or verify that a particular employee(s) is(are) responsible for the known criminal act(s) or to substantiate or to substantiate or dispel the allegation(s) of criminal wrongdoing, he shall so advise the Chancellor, the System President and the appropriate System Vice President in writing. If the evidence gathered supports notifying an agency external to the University, e.g., local police, district attorney, attorney general, etc., where feasible and the circumstances allow her to do so, the notify the Chairman of the Board of Supervisors, who shall notify or cause to be notified, the other members of the Board of Supervisors of the suspected criminal act(s). The President or her designee shall notify the appropriate external agency and provide to it the gathered information and evidence for further action.
When an external agency, business or investigative body contacts University officials or employees regarding the conduct of an employee or student which has given them reasonable cause to suspect criminal wrongdoing by the employee or student, the University official or employee shall direct that party to the Chief of the Campus Police, who shall in turn handle that report as detailed above. If the report is of an emergency nature and time is of the essence, the agency, business or body shall be instructed to file the report with local authorities. The details (name of notifying party, telephone number, details of the incident reported - who, what, when, where, etc.) of the call or notification provided to the official or employee shall immediately be reported to the Campus Police Chief, who shall contact the notifying agency, business or body.
The existence of this policy should not be interpreted so as to discourage the filling of a report of known or suspected wrongdoing by a University employee with immediately notify the Chief of the Campus Police and provide him with a copy of the report and all other relevant information. The handling of the reported wrongdoing shall be in accordance with the above stated procedure.
